  • Bid: the offer to buy a Lot at a specific price.
  • Bidder: a natural or legal person that is attempting to purchase an item at an auction.
  • Buy It Now: a feature on the site which allows buyers to interact with sellers if at the end of an auction the reserve set for the item has not been met.
  • Buyer: the person or entity registered with us and is accepted by us to submit a Bid and a successful bidder acknowledged by the Site or the intermediary platform at the end of the auction to buy the Lot.
  • Commission: a service charge paid by the buyer to the Site, which is added to the successful Bid price.
  • Seller: the individual or company on whose behalf the Site or intermediary platform is auctioning the Lot.
  • Lot: an item or group of items, including but not limited to a Vehicle, number plate or other item offered for sale as one unit.
  • Private treaty sale: a privately negotiated sale, where items are not sold through the auction process.
  • Reserve: the minimum price that the Seller is willing to accept for the Lot.
  • Seller: the person or entity registered with us and is accepted by us to list for sale a Lot.
  • Vehicle: any car or vehicle listed as a Lot on the Site.

By using our site you accept these terms and the Frequently Asked Questions

We only provide a platform for a Seller to list a Lot for sale and a Buyer to bid on the Lot with the intent of purchasing such Lot If the Reserve is met. We do not act as agent of the Seller. We are not involved in the contracting process nor are we a party to the sale contract between the Buyer and the Seller. We merely act at the conduit connecting the two. It is important that you understand this.

You cannot bid on your own Lot or that of someone connected to you, nor can you have a friend or someone connected to you bid on your Lot. If you are a business you will be liable to us and indemnify us for all losses, claims, liability, costs, damages, fines or expenses (including all legal costs) we suffer as a result of your breach of this clause.

Information you provide to us

To offer a Lot for sale, become a Seller or to become a Bidder or Buyer you must register with us. In order to do so you must be aged 18 or over. We will require the following information: your name, address, date of birth, email, phone number, bank account details and such other information required by our third party payments processor Stripe (www.stripe.com) may require whom we use for handling all card payments and credit checks. Any information you provide must be accurate, correct, up to date and not misleading.

As a Seller you must confirm in writing that you have legal ownership of the Lot free from any encumbrance (legal, equitable or otherwise). If any item listed in the Lot is subject to any third party encumbrance (such as finance or is listed as one of the car insurance write-off categories) the full nature of that third party encumbrance and/ or car insurance write-off category information must be obtained and clearly identified and detailed as part of the listing.

For a Buyer, you must register a valid payment method to pay the Commission on achieving a successful Bid.

Any user name password given to you must be kept confidential and you will be fully responsible for use of our Site any communications with us, Buyers/ Sellers and our payment partner using those details. If you feel that your details have been compromised in any way, you must promptly notify us in writing.

You are not permitted to use a username attempting to impersonate anyone.

Listing a Lot

We do not guarantee that a Lot will achieve the Reserve or that you will receive a Bid for the Lot.

If you sell your Lot prior to concluding a sale through the Site, you must immediately remove the Lot from the Site. Any Lot sold within 24 hours of the listing of the Lot ending on the Site will still mean the Seller is liable to pay us our fees.

Any Private treaty sales that are not transacted through the Site or a Seller bidding on its own Lot are not permitted. In circumstances where we feel this has occurred, we reserve the right to charge the Buyer the Commission and the Seller the fees due to us. Failure to make any payments may at our discretion result in your respective accounts being suspended or terminated. Under such circumstances we reserve the right to continue to pursue you for payments due to us.

Any information you provide about the Lot must be accurate, correct up to date and not misleading.

In relation to any Lot, it is the Buyer’s responsibility to verify and check the details recorded in the Lot including but not limited to checking the make, model, condition, description, inspecting the Lot, all charges/ taxes related to the purchase. Further. the Buyer will responsible for his Bid, paying the Commission.

The Buyer and Seller shall be responsible for their respective mistakes in relation to the Lots that they make.

Terminating the services being provided

You can cancel your account with us at any time by informing us of your decision in writing. The cancellation will take effect within 24 hours of our receipt of your written confirmation. Kindly note that this will not apply if you have a successful Bid or agreed to a Buy it Now. Once that event is concluded, you have the right to cancel.

If you are a Seller who has listed a Lot, you cannot cancel this contract until the end of the listing of the Lot.

Events outside of our reasonable control

We shall have no liability to you for any breach of these terms if caused by events, circumstances or causes beyond our reasonable control including, but not limited to, disputes, breakdown of IT/ hardware systems, network access, fire, flood, and other acts of God, accident, pandemic, government guidance on restrictive trading or lockdown.

Disputes

We are not responsible in any way in resolving any disputes between the Buyer and Seller.
